Dozens of Republican senators wrote an open letter to the leadership of Iran, warning them that any nuclear deal signed between Iran and U.S. President Barack Obama might not last beyond his presidency, without Congress signing off on it as well. Here is the text of the letter.
An Open Letter to the Leaders of the Islamic Republic of Iran:
It has come to our attention while observing your nuclear negotiations with our government that you may not fully understand our constitutional system. Thus, we are writing to bring to your attention two features of our Constitution — the power to make binding international agreements and the different character of federal offices — which you should seriously consider as negotiations progress.
First, under our Constitution, while the president negotiates international agreements, Congress plays the significant role of ratifying them. In the case of a treaty, the Senate must ratify it by a two-thirds vote. A so-called congressional-executive agreement requires a majority vote in both the House and the Senate (which, because of procedural rules, effectively means a three-fifths vote in the Senate). Anything not approved by Congress is a mere executive agreement.
Second, the offices of our Constitution have different characteristics.
For example, the president may serve only two 4-year terms, whereas senators may serve an unlimited number of 6-year terms. As applied today, for instance, President Obama will leave office in January 2017, while most of us will remain in office well beyond then — perhaps decades.
What these two constitutional provisions mean is that we will consider any agreement regarding your nuclear-weapons program that is not approved by the Congress as nothing more than an executive agreement between President Obama and Ayatollah Khamenei. The next president could revoke such an executive agreement with the stroke of a pen and future Congresses could modify the terms of the agreement at any time.
We hope this letter enriches your knowledge of our constitutional system and promotes mutual understanding and clarity as nuclear negotiations progress.

جمهوريون يحذرون في رسالة مفتوحة إلى قادة طهران من اتفاق مع ادارة أوباما
واشنطن – وكالات: نشر 42 عضوا جمهورياً في مجلس الشيوخ الأميركي, أمس, رسالة مفتوحة إلى القادة الإيرانيين يحذرون فيها من التوصل إلى اتفاق نهائي مع إدارة الرئيس باراك أوباما بشأن برنامج طهران النووي, في محاولة جديدة لافشال المفاوضات الجارية. ونشرت الرسالة, الموقعة من 42 سيناتوراً من بينهم رئيس الغالبية الجمهورية ميتش ماكونيل ليل أول من أمس, وهي تؤكد أن غالبية كبرى في الكونغرس يجب أن تتبنى أي اتفاق دولي مع إيران كما يجب الأخذ في الاعتبار فترة ولاية أعضاء مجلس الشيوخ, إذ أن المجلس المقبل قد يعدل شروط الاتفاق في أي وقت. وجاء في الرسالة “نحن نعتبر أي اتفاق يتعلق ببرنامجكم للسلاح النووي من دون أن ينال موافقة الكونغرس وكأنه ليس سوى اتفاق تنفيذي بين أوباما والمرشد الأعلى في إيران علي خامنئي”. وأضافت إن “الرئيس المقبل قد يبطل اتفاقا تنفيذيا من هذا النوع بجرة قلم كما أن أعضاء الكونغرس الجدد قادرون على تعديل شروطه في أي وقت”. وأوضح الموقعون على الرسالة, وغالبيتهم من المرشحين لنيل تسمية “الحزب الجمهوري” لخوض السباق الرئاسي العام 2016, أن ولاية أوباما تنتهي في يناير العام 2017 “فيما الكثيرون من بيننا باقون في مناصبهم لفترة أبعد من ذلك, وربما لعقود”.
وتجدر الاشارة إلى أن العلاقات مع الحكومات الخارجية من مسؤولية السلطة التنفيذية في الولايات المتحدة وليس التشريعية. ومساء أول من أمس, أعلن أوباما في مقابلة مع قناة “سي بي اس”, أنه اذا تعذر التوصل الى اتفاق مع ايران فان بلاده ستغادر طاولة المفاوضات. وقال أوباما “بالتاكيد اذا لم يحصل اتفاق سنغادر”, مضيفاً “اذا لم يكن بوسعنا التثبت من أنهم لن يحصلوا على سلاح نووي, ومن أنه سيكون لدينا وقت كاف للتحرك اثناء فترة انتقالية في حال مارسوا الخداع, اذا لم نحصل على هذه الضمانات, لن نقبل باتفاق”. وأكد أنه “من الصحيح القول إن الأمر الآن ملح بعد نحو عام من المفاوضات, والخبر الجيد هو أن ايران التزمت خلال هذه الفترة ببنود الاتفاق” المرحلي الذي أبرم في نوفمبر 2013 مع القوى الست الكبرى. وأضاف “في الوقت نفسه, وصلنا إلى مرحلة في هذه المفاوضات لم يعد الأمر فيها رهن قضايا تقنية بل ارادة سياسية”, مشيراً إلى أن الايرانيين تفاوضوا بجدية وأن تقدما تم احرازه “لتقليص التباينات, لكن ثغرات لا تزال موجودة”.
وأشار إلى أننا “خلال الشهر المقبل سنكون قادرين على تحديد ما اذا كان نظامهم (الايرانيون) قادرا أو لا على القبول باتفاق منطقي بالكامل, ما اذا كانوا مهتمين فقط, كما يقولون, ببرنامج نووي مدني”.على صعيد متصل, أزالت إيران شعار النووي من عملتها النقدية الجديدة من فئة 50 ألف ريال, وتم وضع صورة لمدخل جامعة طهران عوضاً عنه, في خطوة فسرت على أنها تهيئة الرأي العام الإيراني لقبول إيقاف البرنامج النووي لمدة عشر سنوات, حسبما ألمح به وزير الخارجية الإيراني محمد جواد ظريف قبل أيام.وانتقد المحافظون هذه الخطوة بشدة, حيث اعتبر النائب اليميني عضو لجنة الأمن القومي والسياسية الخارجية في البرلمان الإيراني علاء الدين بروجردي, أن “إزالة شعار النووي من العملة خيانة واضحة لدماء الشهداء”, مطالباً البنك المركزي بعدم نشر هذه الفئة من العملة الجديدة. وكان البنك المركزي الإيراني أعلن إصدار ورقة مالية جديدة وصفها ب¯”الشيك” بقيمة 500 ألف ريال (35 يورو), وهي أكبر ورقة نقدية قيمة في عملة إيران منذ إصدار ورقة خمسين ألف ريال في مارس العام الماضي.
